Article 1 - General


Moment Lab. Inc. a company existing and registered under South Korean law (hereinafter referred to as the “Company” or “Moment Pick”) is doing its best to protect the personal information of its users in a safe and secure manner. The Company strives to comply with relevant legal frameworks such as the Act on Promotion of Information and Communication Network Utilization and Information Protection, etc. and the Personal Information Protection Act.


We are doing our absolute best to protect our users’ rights and interests by establishing this privacy policy in accordance with applicable law. We intend to be transparent about the way in which we collect, process, and protect our users’ personal information. This Privacy Policy is disclosed on the Moment Pick website, located at (the “Website”), so that it is easily accessible at any time. 


We reserve the right to amend or update this Privacy Policy from time to time in order to provide a better service, as well as to make sure we are compliance with any updated laws and regulations. If we change or amend this Privacy Policy, we will notify you by updating the Website and by promptly emailing you regarding the changes. You yourself are responsible to regularly check the Website for updates.


If you do not wish for your personal information to be collected, used, provided to third parties, or consigned, you may refuse to give your consent. However, if you do so, you acknowledge and agree that all or part of our services cannot be used by you.


Article 2 - Purpose of Collection and Use of Personal Information


  1. Moment Pick collects a minimum amount of personal information to provide you with our services and to ensure that we can send out useful and appropriate information to our users after they have signed up on the Website.  


  1. Moment Pick does not collect any personal information if such collection will be a significant infringement on our users’ fundamental human rights, such as, among others, personal information relating to race and ethnicity; ideology and creed; place of origin and domicile; political disposition and criminal record; and health status.


  1. The collected personal information is used for the following purposes:


    1. Membership registration: to verify our users’ identity for use of our services; to answer/handle customer inquiries and complaints; to send our various notices; and to build a record for dispute settlement(s).
    2. Service provision: to upload certain content to the Website; to post sellers’ information when registering for sales; to send a notification when content is sold; to provide marketing and service information (optional: after consent users’ may receive SMS or e-mail marketing); to update users on new service(s) and/or events; to test customer satisfaction through marketing events such as surveys and customer interviews; and to use as statistical data for marketing purposes.


Article 3 - Collection of Personal Information


  1. Moment Pick collects the following personal information for membership registration; to handle complaints and questions in our customer care center; and for the provision of various services:


    1. Required information: name, date of birth, (mobile) phone number, gender, and email address;


    1. Optional information: preferences, activity area, shipping address, account information, KakaoTalk ID, Instagram ID, Facebook ID.


  1. In the process of using our services, the following information may be automatically generated and collected:


    1. Collected information: uploaded content, sales registration information, service use record, access log, cookie(s), IP information, device information, etc.


  1. In addition, image or video information may be collected in the process of uploading image and video content to the Website; registering for sale(s); linking an Instagram ID; or during the content sale process. Specifically, (1) information about users is created and stored in an automated way when they use the service, and (2) unique information regarding the users’ device is securely converted and collected so that the original value is anonymized and cannot be verified.


  1. Location information may be collected in the process of using the services. This information may or may not correspond to personal information depending on whether or not it is linked to personal information.


  1. The following payment information may be collected during a payment process.


    1. When requesting a payment: Account information (bank name, account number, account holder).


  1. Users of our services must guarantee the accuracy and legality of their information, and warrant and represent that any information they use is not false information. If we reasonably suspect false information is being used, Moment Pick may remove and block the user from using the service and reserves the right to use any available legal remedy.


Article 4 – Use of Personal Information


Moment Pick uses personal information only for the following purposes:


  1. Personal information is used for user management, such as confirmation of membership registration; age confirmation and legal guardian consent; identification of users and legal guardians; user identification; and confirmation of membership termination.


  1. In addition to providing existing services, such as content (including advertisements), personal information may be used to introduce new service elements such as demographic analysis; analysis of service visits and usage records; communication between users based on personal information and interests; and provision of customized services based on acquaintances and interests. Personal information may also be used to audit and improve existing services.


  1. Personal information is used to prevent and restrict users from violating applicable laws and Moment Pick’s Terms of Use. Moment Pick wants to ensure that there are sanctions for interference, fraud, (information) theft, and other illegal behavior on the service. Personal information is therefore used for user protection and service operation, such as delivering notices, preserving records for dispute settlement, and handling civil complaints.


  1. Personal information is used for marketing and promotion purposes, such as providing event information; participation opportunities; and advertising information.


  1. Personal information is used to record and analyze service usage and access frequency; use statistics; and to provide users with a customized experience based on statistics and analytics.


  1. Personal information is used to build a digital service environment that it secure, private, and safe.  


Article 5 – Use of Personal Information


Moment Pick will destroy all personal information without delay after the purpose of collecting and using such personal information has been achieved. However, if it is necessary to preserve it in accordance with Moment Pick’s internal policies and/or related laws and regulations, Moment Pick will retain the personal information for a certain period, stipulated as follows:

Handling consumer complaints or disputes

  • Retention period: 3 years


Records on identification

  • Reason: Act on Promotion of Information and Communication Network Utilization and Information Protection, etc.
  • Retention period: 6 months


Website visit history

  • Reason: Protection of Communications Secrets Act
  • Retention period: 3 months


Records on electronic financial transactions

  • Reason: Electronic Financial Transactions Act
  • Retention period: 5 years


Tax base of VAT and reporting data of tax amount

  • Reason: Value-added tax law
  • Retention period: 5 years after the final filing period for the taxable period


  1. If a user has given Moment Pick consent to retain certain personal information for periods that are longer than stated above, Moment Pick has the right to retain the personal information in accordance with the period the user has consented to.


Article 6 – Destruction of Personal Information


Users’ personal information is destroyed without delay when the purpose of collecting and using personal information is achieved.


  1. Destruction Procedure: The information entered by a user for membership registration, etc., is transferred to a separate database (separate filing cabinet in the case of paper) after the purpose for which it was collected is achieved and if the retention period as indicated under Article 5 has passed. After a certain period of time in the database, the personal information will be destroyed. Any personal information in the separate database will not be used for any other purpose, except when mandated by law.  


  1. Destruction Method: Personal information printed on paper is destroyed by shredding or incineration. Personal information stored in the form of electronic files is deleted using a technical method that ensures that the record cannot be reproduced.


Article 7 – Third Parties


Moment Pick uses its members’ personal information only in accordance with this Privacy Policy. However, under certain circumstances personal information may be transmitted to a third party:


Recipient: Content purchasing member (business or individual).

Purpose of Provision: To provide seller information for mediation of content copyright license transactions.

Provided information: Nickname, Instagram user ID.

Period of retention and use: After completing the provision of goods or services, the recipient must destroy personal information in accordance with the procedures and retention periods as specified in this Privacy Policy.


Article 8 – Consignment of Third Parties


  1. Moment Pick shall at all times comply with applicable laws regarding personal information protection; confidentiality of personal information; prohibition of provision to third parties; liability in case of accidents consignment period; and the obligation to destroy personal information after processing through consignment business contracts.

Article 9 – User Rights


  1. Users and/or their legal guardians can view or modify their registered personal information at any time and can withdraw their consent to the use of personal information by following the membership termination procedure.


  1. For inquiries and/or modification of personal information, users can view and/or edit by accessing the [My Information] section of the homepage. To cancel a subscription (withdrawal of consent), contact the person in charge of personal information protection in writing, by phone, or by e-mail or on the [My Information] page [Profile]. You can request withdrawal through the [Membership Withdrawal] function at the bottom right.


  1. If a user or their legal guardian requests a correction of errors in personal information, the personal information will not be used or provided to third parties until the correction is completed. Moment Pick processes personal information for which consent has been withdrawn in accordance with this Privacy Policy, and it shall not be viewed or shared with a third party for any purpose.


Article 10 - User Obligations


  1. Users are obligated to protect their own confidential personal information, and Moment Pick is not responsible for any damage caused due to the user’s carelessness, or other unforeseeable problems on the Internet.


  1. Please ensure that any personal information on the Website is accurate and up to date. Users themselves are responsible for any problems arising from incorrect information input by users and may be liable in accordance with the Act on Promotion of Information and Communication Network Utilization and Information Protection.


  1. Users have the obligation to not infringe on the (personal) information of others, or to threaten and/or harm others’ security on the Website. Please be careful not to leak any members’ personal information including ID and password, and be careful not to damage the (personal) information of others, including content.


  1. Users must comply at all times with the Act on Promotion of Information and Communication Network Utilization and Information Protection, Personal Information Protection Act, Resident Registration Act, and other personal information laws.


Article 11 – External Websites


Moment Pick may display links to third-party websites or materials on the Website. Moment Pick has no control over these external websites and materials, and therefore cannot be held responsible or liable for the accuracy or usefulness of the services or materials provided by them. If you enter an external website through our Website, you do so at your own risk, and you should review the external website’s privacy policy.  


Article 12 – User Content and Cookies


  1. Moment Pick values the content provided by its users, and does its best to protect it from tampering, damage, or deletion. However, this does not apply in the following cases:


    1. Spam-like posts (advertisements and links to other sites, etc.)
    2. Content that defames others by spreading false information.
    3. Content that infringes on rights of others, such as disclosure of other people’s personal information without consent, copyrights of Moment Pick, intellectual property rights of third parties, and other content containing inappropriate or harmful content.
    4. Content concerning the installation, operation and rejection of automatic personal information collection devices (cookies, etc.)


  1. Moment Pick uses ‘cookies’ that store and retrieve user information from time to time in order to provide more appropriate and useful services to users. Cookies are used to operate the Website. It is a very small text file that is transferred to the user’s computer and is stored on the user’s computer hard disk. Members can choose whether or not to accept cookies.


  1. How to reject cookie settings: A user can accept all cookies; check every time a cookie is saved; or refuse to save all cookies by adjusting the settings of your web browser. However, please note that refusing to store cookies may limit the use of some services that require login.

Article 13 - Security


Moment Pick is implementing the following protection measures to protect users' personal information:


  1. The user’s password is encrypted. Only the user can know the password. If you want to verify or change any information, you can only do so if you know the password.


  1. Moment Pick uses security measures to prevent the leakage or damage of users’ personal information by hacking or computer viruses. Momentpack takes all possible technical measures to secure more advanced security.


  1. Moment Pick limits the number of employees who process personal information and conducts training for employees from time to time to update and test their knowledge on the implementation of and compliance with this policy.


  1. Moment Pick has established and implemented an internal management plan to manage all internal security issues.


  1. In order to keep access records and prevent forgery, Moment Pick retains and manages records of access to the personal information processing system (web logs, summary information, etc.) for at least 6 months. There is a security system in place to prevent access records from being forged, lost or stolen.


  1. For technical countermeasures against hacking, Moment Pick has installed a security program to prevent leakage and damage of personal information by hacking or computer viruses, and performs periodic updates and inspections of this program.


  1. In order to restrict access to unauthorized persons, Moment Pick has established and operates access control procedures with a separate physical storage location for the personal information system that stores this personal information.

Article 15 - Minors


Some services may be restricted for children under the age of 14 who require the consent of their legal guardian.


Article 16 - Notification


This Privacy Policy will be effective from the effective date specified below. If any changes or revisions are made by the Company, in accordance with applicable law, the users will be notified through the Company’s Website at least 7 days before the changes become effective.
